1. GENERAL PROVISIONS
1.1. Scope of application
These terms and conditions govern the contractual relationship between REAL GW LLC, operating as BALUFY (hereinafter "the Company"), and its clients for all services offered in Mallorca, including tourist accommodations, boat rentals, luxury vehicles, premium experiences, and concierge services.
1.2. Eligibility
- The services are intended for persons over 18 years of age.
- By contracting our services, the client declares and guarantees to be of legal age.
- The company reserves the right to request supporting documentation.
2. PAYMENT METHODS AND CONDITIONS
- Bank transfer (without surcharge).
- Credit/debit card (surcharge 3-5%).
- Cryptocurrencies (surcharge varies according to the cryptocurrency).
- Cards:
- Credit/debit: 3-5% on the total amount.
- The percentage varies according to the cryptocurrency selected.
- The exchange rate shall be fixed at the time of payment.
- The company will inform you of the exact surcharge before confirming the transaction.
3. TOURIST ACCOMMODATION
3.1. Types of Accommodation
- Luxury villas.
- Rural properties.
- Exclusive properties.
- Premium rural accommodation.
3.2. Reserves and Payments
- Initial deposit: 50% of the total cost to confirm the booking.
- Final payment: 50% remaining, two calendar months prior to entry date.
- Security Deposit: Required, refundable within 7 days of departure
3.3. Cancellation Policy
- Cancellations in writing (email).
- Cancellation 60 days or more in advance: loss of 50% of the deposit.
- Cancellation less than 60 days: no right to refund
- In case of re-letting:
- Reimbursement minus 15% handling fee
- Less difference due to possible reduced tariff
3.4. Check-in and Check-out
- Admission: 16:00 hours.
- Departure: 11:00 a.m.
- Alternative times subject to availability.
4. BOAT CHARTER
4.1. Vessel Types and Requirements
- Unlicensed vessels.
- A. Unlicensed Vessels.
- Minimum age: 18 years old.
- No nautical qualification required
- Mandatory safety briefing before departure.
- Navigation limit according to local regulations.
- Maximum capacity according to vessel.
- Licensed Vessels
- Minimum age: 18 years
- Nautical licence valid according to the type of vessel.
- Current personal documentation.
- Demonstrable experience according to type of vessel.
- Navigation area according to qualification
- Maximum capacity according to vessel.
4.2. Terms of payment
- Down payment: 100% of the total amount at the time of booking.
- Deposit: Compulsory, amount depending on type of boat.
4.3. Cancellation Policy
- 30 days or more before the date: full refund.
- Between 29-15 days: 50% penalty
- Less than 15 days: no refund
4.4. Severe Weather Policy
- In case of adverse weather conditions preventing safe navigation:
- Option 1: Change of date at no extra cost (subject to availability).
- Option 2: Full refund.
- The decision on sailing conditions shall be taken by the master or the competent port authority.
- The customer will be informed as far in advance as possible.
5. VEHICLE RENTAL
5.1. Requirements
- Minimum age: 25 years.
- Valid driving licence for at least 3 years.
- Current personal documentation.
5.2. Terms of payment
- Down payment: 100% of the total amount at the time of booking.
- Deposit: Compulsory, amount according to vehicle category.
5.3. Cancellation Policy
- 30 days or more before the date: full refund.
- Between 29-15 days: 50% penalty
- Less than 15 days: no refund
6. PREMIUM EXPERIENCES
6.1. Types of Experiences
- Water activities.
- Visits to wineries.
- Nature walks.
- Gastronomic experiences.
- Helicopter tours.
- Tennis and golf lessons.
- Yoga and Pilates.
- Cooking classes.
- Bicycle routes.
- Hiking in Sierra de Tramuntana.
6.2. Booking Conditions
- Full payment required to confirm.
- Subject to availability and weather conditions.
6.3. Cancellation Policy
- 7 days or more before: full refund.
- Between 6-2 days: 50% penalty.
- Less than 48 hours: no refund
7. CONCIERGE SERVICES
- Restaurant reservation management.
- Organisation of private events.
- Personal shopping.
- Hairdressing and beauty services.
- Personal training.
- Private transport.
- Private medical services
- Professional childcare
- Full payment in advance.
- No refunds are made once the service has been contracted.
- Personalised and non-transferable services.
- Modifications subject to availability
8. FORCE MAJEURE
8.1. Exceptional Circumstances
- Extreme weather conditions.
- Health emergencies.
- Unforeseen circumstances beyond BALUFY's control.
- In these cases, each situation will be studied individually.
9. DISPUTE RESOLUTION AND JURISDICTION
9.1. Legal Framework
- The contractual relationship is governed by the laws of the State of Florida, USA.
- Any dispute, controversy or claim shall be resolved under the laws of the State of Florida.
9.2. Jurisdiction
- The parties expressly submit to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida.

9.3. Dispute Resolution
- The parties agree to attempt to resolve any dispute amicably.
- If an agreement is not reached within 30 days, legal proceedings may be initiated.
- The prevailing party shall be entitled to reimbursement of reasonable attorneys' fees and costs.
9.4. Validity
- If any provision is held invalid, the remaining provisions shall remain in force.
- The English version of these terms shall prevail in case of conflicting translations.
